We may fund the disbursements and part of our work in progress on your case, using a third-party funder or funders to whom we will need to provide your identity details, details of your case, our agreement with you and any insurance bond taken out in respect of your case. By signing or agreeing to our terms of business, you consent to such disclosures and any related case or file audits (internal and external) that our third-party funders may conduct. You may, at any time, instruct us in writing to the contrary.
Our third-party funders comply with Data Protection Legislation when processing, passing on or retaining any personal data of yours. Our third party funders may, however, also need to disclose any details provided to them to their investors and their funders, who may be located in the UK, European Union or USA, subject to appropriate safeguards relating to the transmission of personal data including agreements to depersonalise data where possible, minimise data transfer where possible, non-disclosure agreements and standard data processing contractual protections.
By signing or agreeing to our terms of business, you also consent to such disclosures. If you do not wish your data to be disclosed and/or processed in this way, you may at any time instruct us in writing to the contrary.
By submitting a claim, you authorise Proximo Legal Services to access your credit report through Checkboard Limited, in adherence with Checkboard Limited's Privacy Policy, and Terms and Conditions.
What Information Do We Collect About You?
In general terms, we seek to collect information about you so that we can:
- Administer our relationship with you, provide services and respond to enquiries.
- Process applications for employment.
- Deliver requested information to you about our services and those of our subsidiaries.
- Ensure the billing of any services and obtain payment.
- Process and respond to any complaints.
- Enable us to meet our legal and other regulatory obligations.
- Audit usage of our websites.
- Obtain usage information about your visits to our website which enables our website to remember information about you and your preferences and use of our site.
This may include information about your visit, including the full Uniform Resource Locators (URLs), clicks through to and from our site (including date and time}, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse overs}, methods used to browse away from the page.

Where We Store Your Personal Data

Right to Be Forgotten

How Long Will We Retain Information For?
We will typically retain information for a period of seven years. This is due to regulatory reasons and to ensure our business records are adequate to maintain the requisite levels of insurance to protect our clients and non-clients.
Access to Information
The Data Protection Act 2018 gives you the right to access information held by you. Your right of access can be exercised in accordance with the Act. You are not required to pay a fee unless the request is "manifestly unfounded or excessive" and in those circumstances, we may charge a reasonable fee.
Changes to our Privacy Policy
Any changes we may make to our privacy policy in the future will be posted to our website and, where appropriate, notified to you by e-mail.

Why does Proximo Legal Services collect and store your personal data?
Proximo Legal Services (“Proximo”) is authorised and regulated by the Solicitors Regulation Authority (“SRA”). Our SRA Number is 591916. Proximo provides claims handling services in connection with legal claims.
As part of our business, we retain and process personal data to enable us to provide claims advice. Personal data is provided to us by various routes: for example, data sent to us by insurers about their customers and others, data provided to us by other third parties and data sent to us direct.
We will process your personal data (which may include sensitive personal data) in accordance with the General Data Protection Regulation (2016)
We will also ensure that confidential information provided to us by our clients remains confidential; that it is not disclosed to others, except as may be required to deal with their matters and with appropriate consent, or as may be required by law, including in the detection and prevention of crime.
We may share your personal data with others, for example, insurers and their representatives, crime prevention agencies, including the police, and suppliers to our business. If we do so, it will only be within the process of delivering the services requested by you and in order to progress your claim more efficiently. We may process data through various validation and counter fraud-databases to help us check information provided and assist in the prevention and detection of crime. We may use your personal data for internal training and development purposes.
We will ensure that any third parties who are given access to your personal data are made aware of their duty to keep the information secure and of their obligations under the GDPR; we will also ask our suppliers to ensure that an adequate level of protection and security is applied to your data.
We will endeavour to keep your personal data accurate and up to date and ensure that access to, or disclosure of your information is controlled strictly. We will not keep your information for longer than is necessary; in some instances the law prescribes the length of time information should be retained for, but in most cases we will use our discretion to retain information for as long as it may reasonably be required in connection with our normal business activities and in accordance to our Data Retention and Archiving Policy.

Under the GDPR, Personal Data is defined as data that relates to a living individual who can be identified:

- from that data and other information, which is in the possession of, or likely to come into the possession of, the data controller, and includes any expression of opinion about the individual, and any indication of the intentions of the data controller or any other person in respect of the individual.
Personal data will therefore cover details such as name, address, telephone number, and date of birth, financial information and the nature of any legal services requested.
Under the GDPR, certain data is classified as ‘sensitive personal data’, for example information relating to:

- the commission or alleged commission of any offence.
What information do we collect?
In general, you can use this website without giving us any information. However, additional services may be available to you in return for providing certain information about yourself.

- occupation and company details
- interests in order to provide you with details of our products and services
- details of the circumstances of any claim or incident and any damage, injury or loss suffered by you
- National Insurance number
- employment details
- GP details
- other information relevant to a recruitment process
We may also receive personal information indirectly, for example:
- by contacting third parties in connection with the services we provide to you, for example, medical or other experts;
- if a claimant or a third party refers to you in correspondence or documentation relating to a legal claim;
- from our suppliers, including introducers or referrers;
- from Credit Reference Agencies (please click here for more information in relation to Credit Reference Agencies);
- from public authorities, regulators or law enforcement bodies; or
- an employee of ours gives your contact details as an emergency contact or a referee.
Please note that if you are a third party and we are processing your information in connection with legal proceedings, and/or if legal professional privilege applies, then it is likely we are exempt from any requirement to inform you that we are processing your information.
What do we do with the information we collect?
We use this information to provide you with a better service, and in particular for the following reasons:
- internal record keeping
- to improve our products and services
- send information to you which we think you will find of interest
- provide information relating to you or others if you indicate that you want to receive marketing material or similar communications
- recruitment and selection purposes
- to pass your details to accountants, consultants and other professionals, for the purpose of obtaining professional advice and complying with our contractual obligations

- to perform credit reference or other regulatory checks
- to engage the services of a third party (where instructed)

If you have supplied contact details we may contact you by e-mail, phone, fax or mail.
Whom do we share this information with?
We will not transfer, disclose, sell, distribute or lease your personal information to third parties other than our partners, employees and agents of Proximo to administer any accounts, products and services provided to you by Proximo now or in the future unless we have your permission or are required by law.
We may need to communicate your personal information to other individuals or organisations to facilitate our legal services. For example:
- Medical experts for the purpose of obtaining medical reports or acting as expert witnesses
- Insurance underwriters for the purpose of assessing and validating your claim or to enable them to provide cover under an insurance policy such as legal expenses insurers
- Insurance companies/brokers/third party introducers who referred your claim to us for the purpose of complying with our contractual obligations regarding details of the claim we process
- Credit hire companies you may have contracted
- Any employer who has paid sick pay which is to be recovered as part of your personal injury claim
- Any supplier by virtue of whom you have been introduced to us (such as a Union) for management information purposes
If you are making a claim for mis-sold motor finance then Proximo will perform a soft credit search with Equifax Limited, TransUnion Information Group Limited and/or Experian Limited and receive your electronic credit report from them. You consent to us sharing your Title, Name, Address, Date of Birth and Addresses with Checkboard Ltd for the purposes of obtaining your credit report and verifying your eligibility to claim.
We may also transfer your information to third parties providing us with support and administrative or funding services in connection with the legitimate business purposes associated with the operating of a law firm.
If after providing us with your personal information it becomes apparent we are unable to offer our service to you, we may, with your consent, pass your details to another legal services provider who may be able to assist you.
How to get copies of or amend the information we have collected
You may request details of personal information which we hold about you under the GDPR. If you think any information we have about you is incorrect or incomplete, please write or e-mail us as soon as possible. We will correct or update any information as soon as possible.
Automated decision-making
We may use the personal information you provide to carry out an automated decision making process as to the validity of your identity, as well as to carry out other checks as required by law and regulation (for example, a credit history check or the applicability of any sanctions). If a query arises in relation to any of these checks (i.e. if your identity cannot be validated or other checks raise issues that might prevent the continuance of our legal services to you), a human-led forensic analysis will be undertaken and any decision on our part not to act on your behalf will not be solely automated.
Security
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
Linking
We may link to other websites which are not within our control. Once you have left our website, we cannot be responsible for the protection and privacy of any information which you provide. You should exercise caution and look at the privacy statement applicable to the website in question.
